Amendment 2: Legal Nightmare

As a longtime advocate for domestic violence survivors, I am deeply concerned that Amendment 2 could have a serious negative impact on domestic violence survivors who turn to the criminal or civil legal system for help.
CASA (Community Action Stops Abuse) provides emergency shelter for families fleeing violence at home. Families who use our shelter are in some of the most dangerous situations imaginable. Over half of the women we shelter (and a few men) are not legally married to the person who abused them.
The so-called "Marriage Protection Amendment" appears to intentionally block legal protections for unmarried Floridians using legally undefined language: "Inasmuch as marriage is the legal union of only one man and one woman as husband and wife, no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized."
What is the "substantial equivalent"? What will it mean for domestic violence laws that recognize people "living as if a family"? The courts will be forced to decide.
Much has been written about the danger Amendment 2 poses for firefighters, police officers, seniors and all unmarried couples who may lose essential health care benefits. However, we must also pay attention to how the language of this amendment may lead to serious consequences, especially for battered women.
When Ohio added a similar amendment to its constitution in 2004, voters could not have foreseen that the law would be used as a defense by an alleged domestic violence offender who was not married to the victim. The year after the amendment passed, an Ohio judge reduced the charges against a Cleveland man arrested on domestic violence charges against a woman he lived with, who was not his wife, from a fourth-degree felony (with a possible prison term of six to 12 months) to simple assault (a first-degree misdemeanor with a maximum six-month jail term).
The judge's reasoning? Since Ohio's domestic violence law recognizes the relationship between an unmarried offender and victim as one "approximating the significance or effect of marriage," it represented a direct conflict with their amendment that prohibited such recognition. Thus the judge found this conflict and the charge of domestic violence unenforceable on an offender because they were not married.
Domestic violence advocates in Ohio had a two-year fight that went all the way to the state Supreme Court to finally get the proper charges reinstated.
In the meantime, charges against people accused of domestic violence were dismissed and not reinstated. Also, in some counties, where trial or appellate courts entered bad rulings, prosecutors just stopped charging offenders with domestic violence.
In Florida, domestic violence advocates worked for years to ensure that our civil injunctions for protection (also known as restraining orders) for domestic violence victims are available to victims regardless of their legal marital status if they are "living as if a family." The language of Amendment 2 could eliminate civil injunctive relief now available for domestic violence victims of all ages simply because they are not legally married to their abusive partners.
Even the Florida Legislature's written analysis of Amendment 2 raises red flags about the impact on criminal domestic violence laws and enforcement.
"By invalidating any union or 'substantial equivalent thereof,' this amendment could be raised as a defense in domestic violence cases, resulting in fewer domestic violence convictions," the analysis reads.
Let the legal nightmares elsewhere be a warning that we all have a stake in defeating Amendment 2.
In order to truly protect our families and strengthen healthy relationships free of domestic abuse, we need to be able to protect all individuals equally under strong laws that send the clear message that violence towards anyone is unacceptable. I urge voters to vote "no" on Amendment 2.

The proposed Amendment No. 2 is entitled the "Florida Marriage Protection Amendment" and is described as the protection of "marriage as the legal union of only one man and one woman as husband and wife and provides that no other legal union that is treated as marriage or the substantial equivalent thereof shall be valid or recognized."
First of all, this amendment is unnecessary since Florida does not recognize gay marriage. Second, this law is aimed at homosexual partners and unmarried heterosexual partners and could be used to prohibit employers from extending benefits, such as health insurance, to any domestic partners.
We vote no on this amendment.

Last week we received copies of a mailer sent out by the GOP on behalf of Rep. Sheri McInvale and approved by the candidate.The mailer featured her Democratic challenger Scott Randolph next to a well-known Orlando drag queen and includes the words "Who will pay for their medical bills" and "Wrong for our families". The flier also described Scott Randolph as someone who "can't talk straight". (more)

Yesterday the Florida House of Representatives amended the pending anti-bullying legislation so that our state’s strongest existing safe schools policies will not be repealed. Today the amended bill passed the House of Representatives unanimously: 116-0. (more)
Adoption Coalition Calls on Legislators to Put Well-Being of Children Ahead of Personal Prejudice (TALLAHASSEE) – In the face of reports that foster children, under the care of the Department of Children and Families (DCF), were regularly warehoused for days in a conference room in Tallahassee, state legislative leaders have continued to oppose the call from adoption advocates to allow Florida’s gay and lesbian families to adopt foster children. The Coalition for Fair Adoption, a group of local, state and national child advocacy organizations, is urging all state legislators to stop playing political football with the lives of Florida’s foster children and begin considering the best interest of the child as the only criteria in making adoption decisions.
